Subject: Request for Urgent Action & Public Accountability in Fatal Govandi Dumper Accident on 14th June 2025

Respected Sir,

This letter is being submitted on behalf of Khidmat-e-Khalq Foundation (KKF) — a registered non-profit public interest organization — through its Legal Affairs Division, in reference to the tragic accident on 14th June 2025, at Lotus Junction, Shivaji Nagar, in which four members of a single family, including three minors, were killed after being run over by a speeding dumper that jumped a red signal.

This horrifying event, which took place in a densely populated residential and school zone, has exposed alarming gaps in traffic regulation, signal enforcement, and heavy vehicle control in the Govandi area.

⚖️ Legal and Civic Submissions:

1. Compensation:

The families of the deceased must be granted ex-gratia compensation of ₹25 lakhs per victim, under Article 21 of the Constitution, Section 166 of the Motor Vehicles Act, and as per various Supreme Court directives in similar fatal road negligence cases.

2. Registration of Strong IPC Sections & FIR:

The FIR must reflect appropriate sections:

– IPC 304 Part II (culpable homicide not amounting to murder) , IPC 279, 337, 338 , Section 134 of the MV Act (failure of driver to assist post-accident) Such gross negligence warrants non-bailable, non-compoundable charges.

3. Arrest & Background Disclosure:

The driver and vehicle owner must be arrested immediately. Their license validity, medical fitness, substance testing report, and prior record must be disclosed in public interest.

4. Heavy Vehicle Regulation (Govandi Area):

We request:

– Time-bound prohibition on dumpers and heavy vehicles near Lotus Junction and school areas during peak hours

– Mandatory rerouting of dumpers via the GMLR Flyover

– Installation of automated red-light and speed violation cameras at black spots like Lotus Junction and Baiganwadi Signal

5. GMLR Flyover Structural Concerns:

On 15th June 2025, fresh cracks have once again been reported on the ₹700-crore GMLR Flyover — despite a recent VJTI inspection.

– Was this flyover meant for public safety or only optics?

– Why are heavy vehicles not routed via the flyover?

We demand an independent structural audit, with full public disclosure of its findings.

6. Departmental Responsibility:

If CCTV footage confirms failure of on-duty traffic personnel in controlling signal jumping or overspeeding, a departmental inquiry must be initiated.

7. Joint Committee Formation:

We propose a Local Civic Safety Committee involving Mumbai Traffic Police, BMC, and registered community organizations like KKF to oversee accident-prone zones, recommend policy interventions, and monitor compliance.

We urge your respected office to take urgent, transparent, and time-bound action on the above points to restore public trust in civic enforcement and prevent such tragedies in future.

This representation is also being recorded for legal reference and public awareness. We hope the voices of those who died will not go unheard in the corridors of power.
